NOTICE OF PUBLIC HEARING
ON ASSESSMENT OF WILLOW DRIVE
OVERLAY PROJECT
Notice is hereby given that the Medina city council will meet at 7:00 p.m. on Tuesday, June 18, 2013, at Medina city hall, 2052 Co. Rd. 24, to conduct a public hearing on special assessments against properties benefited by the Willow Drive overlay project. Assessments in the amount of $37,115.10 (out of an estimate total project cost of $168,705) will be levied against all properties in the Willowbrook area benefited by the improvements. Assessments will be levied over a term of 7 years at an annual interest rate of 3.50 percent. The proposed assessment roll is on file and available for inspection at Medina city hall. Written or oral objections to the proposed assessments will be heard by the city council at the hearing. No appeal of an assessment may be taken unless a written objection signed by the property owner is filed with the city clerk prior to the hearing or presented to the presiding officer at the hearing. An owner may appeal the assessment in district court by serving a notice of the appeal on the city clerk or mayor within 30 days after adoption of the assessment and filing such notice with the district court within ten days after service on the clerk or mayor. Persons wishing to express an opinion regarding the special assessment of the project are invited to attend and testify at the hearing or to submit written comments prior to or at the hearing.

NOTICE OF PUBLIC HEARING ON PROPOSED
VACATION OF DRAINAGE AND UTILITY EASEMENTS
NOTICE IS HEREBY GIVEN that the city council of the city of Medina, Minnesota will hold a public hearing on July 2, 2013, at 7:00 PM in the council chambers at city hall, 2052 County Road 24, Medina, MN 55340. The purpose of the public hearing is to consider the vacation of certain drainage and utility easements on Lot 2, Block 2, Tuckborough Farms Fourth Addition and Lot 2, Block 1, Green Pastures Farm. Vacation of the easements is proposed to be contingent upon the city obtaining replacement easements as a result of the rearrangement of the properties.
All persons interested may appear and be heard at the time and place set forth above.

PROJECT DESCRIPTION:
Work consists of asphalt parking lot reconstruction and one new parking lot. Specific work consists of medium and heavy duty asphalt reclaim, concrete curb and gutter replacement, concrete sidewalk replacement, drain tile, tree relocation and other related work.
BID DATE AND LOCATION:
Sealed bids will be received at Rockford District Offices, 651 Ash Street, Rockford, MN 55373, then publicly opened and read aloud. Base Bids will be received and stamped-in prior to 2 PM local time on Thursday, June 13, 2013.
EXAMINATION OF DOCUMENTS:
Bidders may obtain drawings and specifications for the project from Franz Reprographics or from the office of the Program Manager. Plans will be available for review or purchase on May 29, 2013. The bidding documents are on file at the following places:

BIDDING REQUIREMENTS:
Each bidder must comply with the following requirements to reassure acknowledgment recognition of their bids:
Bids must be accompanied by bid security in form of certified check, cashier’s check, or bid bond in amount of 5% of base bid submitted, made payable to owner, as guarantee that bidder will, if awarded, enter into contract in accordance with contract documents and submitted bid.
Submit bid in duplicate on the prescribed form, which is furnished with the specification, with full name and address of the bidder.
Completely fill in all blank spaces on the Bid Form, in ink or typewriter, in both words and figures.
Sign in longhand, executed by a principal duly authorized to enter into an agreement. If a bidder is a co-partnership, then signatures on the bid shall be by an authorized member of the firm, with names and addresses of each member of partnership.
Base bid and all alternate bids shall be stated both in writing and in figures. In all cases, written and numerical figures must agree; otherwise at Owner’s option, it shall be cause for rejection of bid. Complete form without alteration.
Submit alternate prices (bid) for either increasing or decreasing the cost as called for on bid form and Description of Alternates. Submit a bid for all alternates.
Owner may make such investigations as he deems necessary to determine the ability and responsibility of the bidder to perform the work, and any bidder shall furnish to Owner all such information and data for this purpose, as the Owner may request. Owner reserves the right to reject any bid if the evidence submitted by, or investigation of, such bidder fails to satisfy the Owner that such bidder is properly qualified to carry out the obligations of the contract and to complete the Work contemplated therein. The competence and responsibility of bidder will be considered in making an award, including, but not limited to: (1) proof of financial responsibility, (2) quality of similar work, (3) amount of experience with similar projects, (4) facilities, personnel and equipment, (5) reputation for performance, and (6) ability to complete the work within specified time. Owner reserves the right to reject any Bid where there is reasonable doubt as to the qualifications of the bidder.
Owner reserves the right to (1) accept bidder’s Base Bid only, (2) accept any one or more of bidder’s Alternate Bids, in any order regardless of the order in which they were listed, (3) reject all Bids, (4) award contract based on his investigation of bidders, as well as acceptance of alternates, all of which Owner deems to be in their best interest, (5) waive informalities or minor irregularities in bids and waive minor irregularities or discrepancies in bidding procedure.
Upon award of Contract, Contractor shall provide AIA A312 Performance and Payment Bonds in the amount of 100% of Contract Sum in accordance with General Conditions and Amendments to General Conditions.
START DATE:
Work may begin after receipt of the signed contract from Rockford Public Schools. Pre-construction and submittals work related to the project is to commence immediately after receipt of the signed contract. The work on the premise is anticipated to begin on July 1, 2013 or sooner.
SUBSTANTIAL AND COMPLETION DATES:
Owner requires work to be substantially complete on or before August 19, 2013. Final Completion on or before August 30, 2013. Bids shall reflect all costs necessary to meet this schedule requirement.

HENNEPIN AND WRIGHT COUNTIES, MINNESOTA
AN ORDINANCE AMENDING THE CITY CODE TO THE CITY OF ROCKFORD REGARDING ANIMALS.
THE CITY COUNCIL OF THE CITY OF ROCKFORD DOES HEREBY ORDAIN:
Section 502.01 of the City Code is hereby repealed in its entirety and amended to include animal definitions and regulations.
ADOPTED this 28th day of May, 2013, by the City Council of the City of Rockford, Minnesota.
