The Hennepin County Board of Commissioners is soliciting written public comment on the Hennepin County Consortium Draft 2013 Action Plan, which will be submitted to the U.S. Department of Housing and Urban Development (HUD) in May 2013. The Hennepin County Consortium includes all cities in suburban Hennepin County.
Purpose: The 2013 Action Plan will guide the use of approximately $5.7 million in funding for housing and community development activities in suburban Hennepin County: $3.8 million through the Community Development Block Grant Program (CDBG), $1.7 million through HOME Investment Partnerships Program (HOME), and $189,000 through the Emergency Solutions Grant Program (ESG).
Written Comment: Written comments will be accepted for 30 days beginning April 5, 2013, and ending May 6, 2013. Written comments must be submitted by 4:30 p.m., May 6, 2013, and addressed to Kevin Dockry, Manager, Housing Development and Finance, Hennepin County Housing, Community Works and Transit Department, 701 Fourth Avenue South, Suite 400, Minneapolis, MN 55415. Written comments received by May 6 will receive a written response. A copy of the comment letter and the county’s response will be included in the documents submitted to HUD.
The draft 2013 Action Plan will be available April 5, 2013 on the county’s website homepage under “Notices” (www.hennepin.us). Copies of the plans will also be available for review at the suburban Hennepin County Regional Libraries (Brookdale, Ridgedale, and Southdale) until May 6, 2013. THE CITY OF INDEPENDENCE DOES ORDAIN:
Section 1. Section 525.01 of the Independence City Code is hereby amended as follows:
525.01. Land use districts. The city of Independence is hereby divided into land use districts identified by the following name and symbol:
Rural Residential (RR);
Urban Residential (UR);
Commercial-Light Industrial (CLI);
Urban Commercial (UC)
Public / Recreational Overlay District (PR)
Section. 2 Section 530 of the Independence City Code is hereby amended as follows:
530.27. Public/Recreational Overlay District – purpose and authorization. The City recognizes the benefits to the public health, safety and general welfare of encouraging and protecting open space, natural resources, lakes, streams, recreational areas and public facilities. This overlay zone will support the future preservation of parks, natural resources, recreational areas and public facilities. This overlay district directly corresponds to the City’s Comprehensive Land Use Plan.
530.29. Designation of the public/recreational overlay district. The Public/Recreational Overlay District shall include all land designated as Public/Semi-Public on Figure 7 in the City of Independence official Comprehensive Land Use Plan. The Public/Recreational Overlay District shall be shown on the official zoning map of the City.
The remainder of section to be renumbered accordingly.
Sec. 3. This ordinance shall take effect upon the day of publication.

NOTICE OF A PUBLIC HEARING WITH RESPECT TO THE ISSUANCE OF REVENUE BONDS TO FINANCE A MULTIFAMILY HOUSING DEVELOPMENT IN ACCORDANCE WITH THE PROVISIONS OF MINNESOTA STATUTES, CHAPTER 462C, AS AMENDED; AND APPROVING A HOUSING PROGRAM FOR THE MULTIFAMILY HOUSING DEVELOPMENT AND APPROVING A COOPERATION AGREEMENT WITH THE CITY OF CHASKA
NOTICE IS HEREBY GIVEN that the City Council of the City of Independence, a statutory city of the State of Minnesota (the “City”), will hold a public hearing on Tuesday, April 23, 2013, on or after 7:30 p.m. at City Hall, 1920 County Road 90, Independence, Minnesota 55359, on a proposal to issue revenue bonds of the City (the “Bonds”) under Minnesota Statutes, Chapter 462C, as amended (the “Housing Act”), to finance a multifamily housing development to be located in the City of Chaska. The proceeds of the Bonds are proposed to be loaned to The Legends at Hazeltine, LLC, a Delaware limited liability company (the “Borrower”), the members of which are Ridgeview Medical Center, a Minnesota nonprofit corporation, and Intergenerational Living & Health Care, Inc., a Minnesota nonprofit corporation. The proceeds of the loan are proposed to be applied to the following: (i) the acquisition, construction and equipping of an approximately 125-unit progressive senior living community comprised of approximately 35 independent-living units, approximately 67 assisted-living units, and approximately 23 memory-care units, to be located in the City of Chaska (the “Project”); (ii) the funding of one or more reserve funds to secure the timely payment of the Bonds; (iii) the payment of a portion of the interest on the Bonds; and (iv) the payment of a portion of the costs of issuing the Bonds. The Project will be owned and operated by the Borrower. The Project will be located on an approximately 6.71-acre parcel in the City of Chaska bounded on the west by Highway 41, on the south by Hazeltine Boulevard, on the north by the City of Chaska golf course, and on the east by Hazeltine Gates office building (1107 Hazeltine Boulevard).
Following the public hearing, the City Council will consider the adoption of a resolution: (i) approving a Housing Program with respect to the Project prepared in accordance with the requirements of the Housing Act, (ii) approving a Cooperation Agreement between the City and the City of Chaska pursuant to which the City of Chaska will authorize the City to issue the Bonds to finance the Project; and (iii) granting preliminary approval to the issuance of the Bonds. The Bonds are proposed to be issued in a principal amount of approximately $28,000,000. The Bonds will be issued by the City and will constitute limited obligations of the City payable solely from the revenues expressly pledged to the payment thereof, and will not constitute general obligations of the City and will not be secured by any taxing powers of the City nor any assets or property of the City except the interests of the City in the Project that may be granted to the City in conjunction with this financing.
A copy of the Housing Program has been submitted to the Metropolitan Council as required by the terms of the Housing Act and is on file in the offices of the City Administrator-Clerk.
Anyone desiring to be heard during this public hearing will be afforded an opportunity to do so. Written comments will be considered if submitted to the attention of the City Administrator-Clerk on or before the date of the public hearing.
