ORDINANCE NO. 2013 – 01
AN ORDINANCE AMENDING SECTION 2-44
RELATING TO CRIMINAL HISTORY BACKGROUND CHECKS
The Rogers City Council ordains as follows:
Section 2-44 is hereby deleted and replaced with the following:
Section 1. APPLICANTS FOR CITY EMPLOYMENT
PURPOSE: The purpose and intent of this section is to establish regulations that will allow law enforcement access to Minnesota’s Computerized Criminal History information for specified non-criminal purposes of employment background checks for the positions described in Section 2.
Section 2. CRIMINAL HISTORY EMPLOYMENT BACKGROUND INVESTIGATIONS:
The Rogers Police Department is hereby required, as the exclusive entity with the City, to do a criminal history background investigation on the applicants for the following positions within the City, unless the City’s hiring authority concludes that a background investigation is not needed:
(a) Employment Positions: Shall include all regular part-time and full-time employees of the City of Rogers and other positions that work with children or vulnerable adults.
In conducting the criminal history background investigation in order to screen employment applicants, the Police Department is authorized to access data maintained in the Minnesota Bureau of Criminal Apprehensions Computerized Criminal History information system in accordance with BCA policy. Any data that is access and acquired shall be maintained at the Police Department under the care and custody of the chief law enforcement official, or his/her designee. A summary of the results of the Computerized Criminal History data may be released by the Police Department to the hiring authority, including the City Council, the City Administrator, or other City staff involved in the hiring process.
Section 3. AUTHORIZATION FOR INVESTIGATION
Before the Investigation is undertaken, the applicant must authorize the Police Department, in writing, to undertake the investigation. The written consent must fully comply with the provisions of Minn. Stat. Chap. 13 regarding the collection, maintenance, and use of the information. Except for the positions set forth in Minn. Stat. §364.09, the City will not reject an applicant for employment on the basis of the applicant’s prior conviction unless the crime is directly related to the position of employment sought and the conviction is for a felony, gross misdemeanor, or misdemeanor with a jail sentence. If the City rejects the applicant’s request on this basis, the City shall notify the applicant in writing of the following:
a. The grounds and reasons for the denial.
b. The applicant complaint and grievance procedure set forth in Minn. Stat. §364.06.
c. The earliest date the applicant may reapply for employment.
d. That all competent evidence of rehabilitation will be considered upon reapplication.
Section 4. This Ordinance shall take effect and be in full force from and after its passage and publication.

AN ORDINANCE AMENDING SECTION 22-1
RELATING TO APPLICATION FOR LICENSE/OR PERMITS AND CRIMINAL HISTORY BACKGROUND CHECKS
The Rogers City Council ordains as follows:
Section 22-1 is hereby deleted and replaced with the following:
Section 1. Section 22-1 of the Rogers City Code is amended as follows:
APPLICANTS OF CITY LICENSES
PURPOSE: The purpose and intent of this section is to establish regulations that will allow law enforcement access to Minnesota’s Computerized Criminal History information for specified non-criminal purposes of licensing background checks. Every applicant for a license shall submit an application to the clerk on a form provided by the city. It shall be accompanied by the prescribed fee.

(1) CRIMINAL HISTORY LICENSE BACKGROUND INVESTIGATIONS: When applicable, the Rogers City Police Department is hereby required, as the exclusive entity within the City, to do a criminal history background investigation on applicants for city licenses. Before the investigation is undertaken, the applicant must authorize the police department, in writing, to undertake the investigation. and to release the information to the city council, city administrator or other city staff as appropriate. The written consent must fully comply with the provisions of Minn. Stat. Chap. 13 regarding the collection, maintenance and use of the information.
In conducting the criminal history background investigation in order to screen license applicants, the Police Department is authorized to access data maintained in the Minnesota Bureau of Criminal Apprehensions Computerized Criminal History information system in accordance with the BCA policy. Any data that is accessed and acquired shall be maintained at the Police Department under the care and custody of the chief law enforcement official or his/her designee. (2) Issuance. If, after investigation, the chief of police is satisfied that all requirements of law and this Code have been met, the chief shall present the application to the council for action, or if the license or permit does not require council approval, the chief of police shall issue the license or permit.
(3) Denial for background. Except in the case of exceptions for the positions set forth in Minn. Stat. §364.06, should the city deny the applicant’s request for a license, due partially or solely to the applicant’s prior conviction of a crime, the chief of police shall notify the applicant in writing of the following the city will not reject an applicant for a license on the basis of the applicant’s prior conviction unless the crime is directly related to the license sought and the conviction is for a felony, gross misdemeanor, or misdemeanor with a jail sentence. If the City rejects the applicant’s request on this basis, the City shall notify the applicant in writing of the following:
A. The grounds and reason for denial.
B. The applicant complaint and grievance procedure set forth in Minn. Stat. §364.06.
C. The earliest date the applicant may reapply for the license.
D. That all competent evidence of rehabilitation will be considered upon reapplication.

Notice is hereby given that the City Council of the City of Albertville, Minnesota will meet at 7:00 p.m. on Tuesday, February 19, 2013 at City Hall, 5959 Main Avenue NE in the City of Albertville, Minnesota, to conduct a public hearing regarding a proposed business subsidy to be granted to Fraser Building Limited Partnership under Minnesota Statutes, Sections 116J.993 to 116J.995 (the “Business Subsidy Act”). A summary of the terms of the proposed business subsidy are available for inspection at City Hall during regular business hours on and after the date of this notice. Any person with residence in or the owner of taxable property in the granting jurisdiction may file a written complaint with the City Council if the City Council fails to comply with the Business Subsidy Act. No action may be filed against the City Council for the failure to comply unless a written complaint is filed.
Any person wishing to express an opinion on the matters to be considered at the public hearing will be heard orally or in writing.

AN ORDINANCE AUTHORIZING THE ISSUANCE OF TEMPORARY ON-SALE 3.2 MALT LIQUOR LICENSES TO CLUBS, AND RELIGIOUS, CHARITABLE AND NON-PROFIT ORGANIZATIONS
The City Council of the City of Albertville, Minnesota hereby ordains:
Section 1. Title 4 Chapter 1, Section 4.D.1. of the Albertville City Code is hereby amended to read as follows:
D. Temporary 3.2 Percent Malt Liquor On-Sale Licenses:
1. Limited License: Notwithstanding other licensing requirements for 3.2 percent malt liquor, the city council, upon proper application, may, in its discretion, grant limited licenses to sell 3.2 percent malt liquor on-sale to bona fide clubs which meet the definition of Minnesota statutes section 340A.101, subdivision 7, and to charitable, religious or non-profit organizations.
Section 2. This ordinance shall be effective upon its passage and publication.
