NOTICE OF ASSESSMENT LIEN FORECLOSURE SALE
NOTICE IS HEREBY GIVEN that default has been made in the terms and conditions of the Declaration of Kittredge Crossings Townhomes Association, Inc. (henceforth the “Declaration”) recorded in the office of the Recorder for Wright County, Minnesota on December 17, 2004, as Document No. A939635, which covers the following property:
Lot 23, Block 3, Kittredge Crossing 6th Addition, Common Interest Community Number 98, Wright County, Minnesota
WHEREAS, pursuant to said Declaration, there is claimed to be due and owing as of December 6, 2012, from Ashley R. Huseth and Nathaniel B. Vetvick, title holders, to Kittredge Crossings Townhomes Association, Inc., a Minnesota non-profit corporation, the principal amount of Eleven Thousand Eight Hundred Forty-Eight and 89/100 Dollars ($11,848.89) for assessments, late fees and related charges, plus assessments, collection costs, attorneys’ fees and other amounts will be incurred since said date, including costs of collection and foreclosure;
WHEREAS, no action is now pending at law or otherwise to recover said debt or any part thereof;
WHEREAS, Ashley R. Huseth has been discharged from personal responsibility for all amounts due prior to her Chapter 7 bankruptcy petition, filed in the United States Bankruptcy Court, District of Minnesota on December 29, 2009, as Petition No. 09-48792.
WHEREAS, pursuant to the Declaration and Minn. Stat. §515B.3-116(h), said debt created a lien upon said premises in favor of Kittredge Crossings Townhomes Association, Inc. as evidenced by the lien statement recorded on March 15, 2012, in the office of the Wright County Recorder as Document No. A1197603;
WHEREAS, pursuant to the power of sale granted by the owner(s) in taking title to the premises subject to said Declaration, said lien will be foreclosed by the sale of said property by the sheriff of said county at the Wright County Sheriff’s Department, 3800 Braddock Avenue NE, Buffalo, Minnesota, on January 31, 2013, at 10:00 o’clock a.m., at public auction to the highest bidder, for cash, to pay the amount then due for said assessments, together with the costs of foreclosure, including attorneys’ fees as allowed by law. The time allowed by law for redemption by the unit owners, their personal representatives or assigns is six (6) months from the date of said sale.
The following information is provided pursuant to Minnesota Statutes Sections 580.025 and 580.04:

If you believe the Plaintiff should not be given everything asked for in the Complaint, you must say so in your Answer.

That part of the Northeast Quarter of Southeast Quarter of Section 4, Township 118, Range 27, described as follows: Commencing at the Northwest corner of said Northeast Quarter of Southeast Quarter; thence South along the West line of said Northeast Quarter of Southeast Quarter a distance of 204.00 feet to the South line of William Street; thence East, along said South line, parallel with the North line of said Northeast Quarter of Southeast Quarter, a distance of 173 feet to the actual point of beginning; thence continue East, along said South line, parallel with the North line of said Northeast Quarter of Southeast Quarter a distance of 100 feet; thence South, parallel with the West line of said Northeast Quarter of Southeast Quarter a distance of 150 feet; thence West, parallel with the North line of said Northeast Quarter of Southeast Quarter a distance of 100 feet; thence North parallel with the West line of said Northeast Quarter of Southeast Quarter a distance of 150 feet to the point of beginning.

The object of this action is to:
(i) foreclose that certain mortgage dated September 5, 2008, filed September 18, 2008, as Wright County Recorder Document No. A1098325, and
(ii) seek a declaration regarding the relative priority of the above-described mortgage in relation to any interest in the real estate claimed by the named defendants.
8. NOTICE OF PERSONAL CLAIM PURSUANT TO MINN. STAT. SEC. 557.03. A personal judgment is only being sought against the following defendants: Howard Lake Storage, LLC, a Minnesota limited liability company, and Dennis M. Peterson.

LEGAL NOTICE
CITY OF INDEPENDENCE
The Planning Commission will hold a public hearing in the Council Chambers at 1920 County Road 90 on Monday, January 14, 2013 at 7:30 p.m. to review the following requests:
1. A + D Properties, LLC (Applicant) and Donald Baird (Owner) request that the City consider the following actions for the property located at 2076 County Road 90, Independence, MN (PID No. 23-118-24-23-0001):
a. Rezoning of the subject property from AG-Agriculture to CLI-Commercial-Light Industrial.
2. Carla J. Smith, Owner of the property located at 3826 Independence Road (PID NO. 12-118-24-22-0006), and James W. and Mary R. Smith Owners of the property located at 3858 Independence Road (PID NO. 12-118-24-22-0005), are requesting the following action from the City:
a. A minor subdivision to permit a lot line rearrangement which would reconfigure the boundaries of the two properties.
3. A proposed text amendment to the City of Independence Ordinances as follows:
