NOTICE OF ASSESSMENT LIEN FORECLOSURE SALE
NOTICE IS HEREBY GIVEN that default has been made in the terms and conditions of the Declaration of Kittredge Crossings Townhomes Association, Inc. (henceforth the “Declaration”) recorded in the office of the Recorder for Wright County, Minnesota on December 17, 2004, as Document No. A939635, which covers the following property:
Lot 6, Block 3, Kittredge Crossings 6th Addition, Common Interest Community No. 98, Wright County, Minnesota
WHEREAS, pursuant to said Declaration, there is claimed to be due and owing as of October 19, 2012, from Jessica L. Zahner, title holder, to Kittredge Crossings Townhomes Association, Inc., a Minnesota non-profit corporation, the principal amount of Six Thousand Seven Hundred Sixty-Five and 89/100 Dollars ($6,765.89) for assessments, late fees and related charges, plus assessments, collection costs, attorneys’ fees and other amounts will be incurred since said date, including costs of collection and foreclosure;
WHEREAS, no action is now pending at law or otherwise to recover said debt or any part thereof;
WHEREAS, the owner has not been released from the financial obligation to pay said amount;
WHEREAS, pursuant to the Declaration and Minn. Stat. §515B.3-116(h), said debt created a lien upon said premises in favor of Kittredge Crossings Townhomes Association, Inc. as evidenced by the lien statement recorded on May 10, 2012, in the office of the Wright County Recorder as Document No. A 1202409;
WHEREAS, pursuant to the power of sale granted by the owner(s) in taking title to the premises subject to said Declaration, said lien will be foreclosed by the sale of said property by the sheriff of said county at the Wright County Sheriff’s Department, 3800 Braddock Avenue NE, Buffalo, Minnesota, on December 18, 2012, at 10:00 o’clock a.m., at public auction to the highest bidder, for cash, to pay the amount then due for said assessments, together with the costs of foreclosure, including attorneys’ fees as allowed by law. The time allowed by law for redemption by the unit owners, their personal representatives or assigns is six (6) months from the date of said sale.

TO: THE STATE OF MINNESOTA TO THE ABOVE-NAMED DEFENDANTS:
1. YOU ARE BEING SUED. The Plaintiffs have started a lawsuit against you. The Plaintiff’s Complaint against you is attached to this Summons. Do not throw these papers away. They are official papers that affect your rights. You must respond to this lawsuit even though it may not yet be filed with the Court and there may be no Court file number on this Summons.
2. YOU MUST REPLY WITHIN 20 DAYS TO PROTECT YOUR RIGHTS. You must give or mail to the person who signed this Summons a written response called an Answer within 20 days of the date on which you received this Summons. You must send a copy of your Answer to the person who signed this Summons located at Dolan & Besser, 409 North Sibley Avenue, Litchfield, MN 55355.
3. YOU MUST RESPOND TO EACH CLAIM. The Answer is your written response to the Plaintiff’s Complaint. In your Answer you must state whether you agree or disagree with each paragraph of the Complaint. If you believe the Plaintiff should not be given everything asked for in the Complaint, you must say so in your Answer.
4. YOU WILL LOSE YOUR CASE IF YOU DO NOT SEND A WRITTEN RESPONSE TO THE COMPLAINT TO THE PERSON WHO SIGNED THIS SUMMONS. If you do not Answer within 20 days, you will lose this case. You will not get to tell your side of the story, and the Court may decide against you and award the Plaintiff everything asked for in the Complaint. If you do not want to contest the claims stated in the Complaint, you do not need to respond. A Default Judgment can then be entered against you for the relief requested in the Complaint.
5. LEGAL ASSISTANCE. You may wish to get legal help from a lawyer. If you do not have a lawyer, the Court Administrator may have information about places where you can get legal assistance. Even if you cannot get legal help, you must still provide a written Answer to protect your rights or you may lose the case.

Zoning Ordinance Amendment
Notice is hereby given that the Corcoran Planning Commission will hold a public hearing at City Hall, 8200 County Road 116, on Thursday, December 6, 2012 at 7:00 pm or as soon as the item may be heard, to consider a request by the City of Corcoran for an amendment to Section 1070.020 of the Zoning Ordinance regarding conditional use permit amendments. The amendment would allow conditional use permit amendments to be processed administratively rather than through the public hearing process as currently required.
All persons wishing to speak on the item will be heard. Comments may be submitted in writing prior to the hearing.

The Corcoran City Council will hold a public hearing on its 2013 City Budget and on the amount of Property Taxes it is proposing to collect to pay for the costs of services the city will provide in 2013.
SPENDING: The total budget figures below compare the City’s 2012 total budget with the amount the City proposes to spend in 2013.

The Rockford City Council hereby ordains that the city code is amended as follows delete/add:
Section 1. 701. Liquor.
701.03 Definitions.
RESTAURANT An eating facility, other than a hotel, under the control of a single proprietor or manager, where meals are regularly prepared on the premises, where full waitress/waiter table service is provided, where a customer orders food from printed menus and where the main food course is served and consumed while seated at a single location. To be a restaurant as defined by this section, an establishment shall have a license from the state as required by M.S. §157.16, as it may be amended from time to time, and meet the definition of either a “limited establishment”, “small establishment,” “medium establishment” or “large establishment” as defined in M.S. §157.16, subd. 3d, as it may be amended from time to time. An establishment which serves prepackaged food that receives heat treatment and is served in the package or frozen pizza that is heated and served, shall not be considered to be a restaurant for purposes of this chapter unless it meets the definitions of a “small establishment”, “medium establishment” or “large establishment”. Deleted entirely.

LIMITED ESTABLISHMENT is defined as a food service that provides one or more of the following:
(i) Prepackaged food that receives heat treatment and is served in the package;
(ii) Frozen pizza that is heated and served;
In addition the city requires a small menu of 10 items or more that are heated and served on the premises and a seating capacity of at least thirty (30) persons.
701.06 Kinds of Liquor Licenses
Subd. 6. Sunday on-sale intoxicating liquor licenses as provided by MS 340A.504 Subd. 3 as it may be amended from time to time. Sunday on-sale intoxicating liquor licenses may be issued only to a restaurant as defined in Section 701.03 of this ordinance, clubs, bowling center, or hotel which has a seating capacity of at least thirty (30) persons, which holds an on-sale intoxicating liquor license and which serves liquor only in conjunction with the service of food. Sunday on-sale 3.2 malt liquor license requires Council approval.
Section 2. Effective Date. This ordinance shall become effective upon the date of publication.
