Notice is hereby given that the City Council of the City of Corcoran will hold a public hearing in the council chambers of the city hall on Thursday, November 8, 2012 at 7:00 p.m., or soon thereafter as the agenda allows, to consider the assessment of delinquent fees pursuant to Minn. Stat. 429.011 to 429.111. Such persons as desire to be heard with reference to the proposed assessment will be heard at this meeting.

NOTICE OF ASSESSMENT LIEN FORECLOSURE SALE
NOTICE IS HEREBY GIVEN that default has been made in the terms and conditions of the Declaration of Kittredge Crossings Townhomes Association, Inc. (henceforth the “Declaration”) recorded in the office of the Recorder for Wright County, Minnesota on December 17, 2004, as Document No. A939635, which covers the following property:
Lot 6, Block 3, Kittredge Crossings 6th Addition, Common Interest Community No. 98, Wright County, Minnesota
WHEREAS, pursuant to said Declaration, there is claimed to be due and owing as of October 19, 2012, from Jessica L. Zahner, title holder, to Kittredge Crossings Townhomes Association, Inc., a Minnesota non-profit corporation, the principal amount of Six Thousand Seven Hundred Sixty-Five and 89/100 Dollars ($6,765.89) for assessments, late fees and related charges, plus assessments, collection costs, attorneys’ fees and other amounts will be incurred since said date, including costs of collection and foreclosure;
WHEREAS, no action is now pending at law or otherwise to recover said debt or any part thereof;
WHEREAS, the owner has not been released from the financial obligation to pay said amount;
WHEREAS, pursuant to the Declaration and Minn. Stat. §515B.3-116(h), said debt created a lien upon said premises in favor of Kittredge Crossings Townhomes Association, Inc. as evidenced by the lien statement recorded on May 10, 2012, in the office of the Wright County Recorder as Document No. A 1202409;
WHEREAS, pursuant to the power of sale granted by the owner(s) in taking title to the premises subject to said Declaration, said lien will be foreclosed by the sale of said property by the sheriff of said county at the Wright County Sheriff’s Department, 3800 Braddock Avenue NE, Buffalo, Minnesota, on December 18, 2012, at 10:00 o’clock a.m., at public auction to the highest bidder, for cash, to pay the amount then due for said assessments, together with the costs of foreclosure, including attorneys’ fees as allowed by law. The time allowed by law for redemption by the unit owners, their personal representatives or assigns is six (6) months from the date of said sale.
The following information is provided pursuant to Minnesota Statutes Sections 580.025 and 580.04:

The Planning Commission will hold a public hearing in the Council Chambers at 1920 County Road 90 on Monday, November 19, 2012 at 7:30 p.m. to review the following requests:
Hold Your Horses, a Minnesota non-profit, requests that the City consider the following actions for the property located at 6824 County Road 6, Independence, MN (PID No. 34-118-24-21-0003):

Notice is given that an application for informal probate of the Decedent’s will dated February 15, 1995, (“Will”), has been filed with the Registrar. The application has been granted.
Notice is also given that the Registrar has informally appointed Rolland E. Glessing, whose address is 1820 Holly Lane North, Plymouth, Minnesota 55447, as personal representative of the Estate of the Decedent. Any heir, devisee or other interested person may be entitled to appointment as personal representative or may object to the appointment of the personal representative. Unless objections are filed with the Court (pursuant to Minn. Stat. 524.3-607) and the Court otherwise orders, the personal representative has full power to administer the Estate including, after 30 days from the date of issuance of letters, the power to sell, encumber, lease or distribute real estate.
Any objections to the probate of the will or appointment of the Personal Representative must be filed with this Court and will be heard by the Court after the filing of an appropriate petition and proper notice of hearing.
Notice is also given that (subject to Minn. Stat. 524.3-801) all creditors having claims against the Estate are required to present the claims to the personal representative or to the Court Administrator within four months after the date of this Notice or the claims will be barred.

A RESOLUTION APPROVING PUBLICATION OF
ORDINANCE NO.’S 2012-07, 2012-09 and 2012-10 BY TITLE AND SUMMARY
WHEREAS, on September 25, 2012, the City Council of the City of Independence adopted the following ordinances:
Ordinance No. 2012-07 (Amending Chapter 5 of the Independence City Code to include Section 509, a new Section adding provisions for Storm Water Management); and
Ordinance No. 2012-09 (Amending Chapter 5 of the Independence City Code to include Section 509, a new Section adding provisions for Storm Water Management and to amend Section 508 relating to Erosion and Sediment Control); and
Ordinance No. 2012-10, (Amending Chapter 7 of the Independence City Code to include Section 725, a new Section pertaining to Storm Water Utilities);
WHEREAS, the ordinance totals, respectively are 11, 21, and 8 pages for a total of 40 pages in length; and
WHEREAS, Minnesota Statutes, § 412.191, subd. 4, allows publication by title and summary in the case of lengthy ordinances; and
WHEREAS, the City Council believes that the following summary would clearly inform the public of the intent and effect of the ordinance.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF INDEPENDENCE:
1. The City Council of the City of Independence has adopted Ordinance No.’s 2010-07, 2010-09 and 2012-10. The ordinances are intended to add the City’s Land Use Water Management Plan to the City Code, to clarify existing water use plans, and to amend or change the City’s current water use management requirements to a limited extent. Accordingly, the ordinance codifies and amends the City’s existing water use management, policies and requirements.
2. The City Administrator is directed to publish this resolution in lieu of publication of the entire ordinance.
3. The City Administrator is directed to make a copy of the entire text of Ordinance No.’s 2010-07, 2012-09 and 2012-10 to make available at City Hall.
